While some of Paulo Freire's readers understand his pedagogy as a rejection of any and all directive teaching methods, there are many scholars who do recognise Freire's emphasis on teacher directiveness in its appropriate form. In light of this tension between directiveness and dialogue, it seems that students of Freire must inevitably come to a crossroads: is Freire's pedagogy directive or is it not? However, even this question does not get at the more critical dilemma: if Freire's pedagogy is directive, (...) is such directiveness incompatible with Freire's overwhelming emphasis on egalitarian dialogue? This paper establishes three readings of the issue of directiveness in Freire and ultimately provides an exegetical defence of what is termed the compatibilist reading—that directive teaching, properly construed, is compatible with dialogic teaching in Freirean pedagogy. The question this paper seeks to answer is how Freire can have it both ways. In sum, Freire undeniably supports teacher directiveness and philosophically justifies directiveness as compatible with problem-posing education through his concepts of virtue education, utopia and criticality. Despite its several variations, the central position of equipoise is that subjects in clinical experiments should not be randomized to conditions when others believe that better alternatives exist. This position has been challenged over issues of which group in the medical or research community is authorized to make that determination, and it has been argued that informed consent provides sufficient ethical protection for participants independent of equipoise. In this paper I frame ethical participation in clinical research as a two-party decision (...) process involving offering and accepting participation under informed consent. Nine conditions are identified in which it is possible that potential participants and researchers or care professionals can rationally choose divergent actions based on identical understandings of the situation. Under such circumstances, researchers or care professionals cannot ethically substitute their understanding of equipoise in the situation for the patients’ choices, or vice versa. (shrink)

Building the Moral Community is an exploration of naturalistic ethics, offering a modified classical analytic philosophy exploration of morality that is consistent with emerging thinking in psychology, neurobiology, game theory, and self-adjusting systems.

Current empirical studies of moral behavior of healthcare professionals are almost entirely focused on self-reports, usually collected under the assumption that an ethical disposition characterizes individuals across various contexts. It is well known, however, that individuals adjust their behavior to what they see being done by those in their peer group. That presents a methodological challenge to traditional research within a community of peers because the behavior of each individual is both the result of norms and a contributor to the (...) norms of others. Computer simulations can be used to address this methodological challenge. A Markov replicator model that runs on an Excel spreadsheet was used to investigate a community with four agent types in the dental community: devious practitioners, ethical practitioners who avoid involvement in the poor ethics of others, ethical practitioners who accept it as part of their professional responsibility to challenge colleagues who act unprofessionally, and those who enforce ethical standards. A panel of leaders in the profession independently estimated parameters for the model and criteria for a possible distribution of agent types in the community. The simulation converged on distributions of the agent types that were very similar to the expectations of the panel. The simulation suggests the following characteristics of such moral communities: The structure of such communities is robust across a wide distribution. It appears that reduction in unethical behavior is more sensitive to the way ethical practitioners interact with each other than to sanctions the enforcement community imposes on unethical practitioners, and that large external interventions will be short lived. Corresponding correlations is a method that allows us to infer formal causation from correlational data. In this paper, causal terms are traced to their philosophical and etymological roots. It is argued that causes are parts of their mutual whole . Nominalism, normal distributions and disjunctive causes are linked. Causal manifolds and sampling by potential are used to model conjunctive causes. Corresponding correlations are then demonstrated through simulations, in which causal relations are differentiated from spurious correlations. An algebraic method for unraveling (...) confounded variables is presented. Distinctions between laws and causes are made and related to corresponding correlations. The conclusion is that corresponding correlations should be a significant advance in causal inference. (shrink)

From the late eighteenth through the end of the nineteenth century, educational philosophers and practitioners debated the benefits and shortcomings of the use of emulation in schools. During this period, “emulation” referred to a pedagogy that leveraged comparisons between students as a tool to motivate them to higher achievement. Many educationists praised emulation as a necessary and effective motivator. Other educationists condemned it for its tendency to foster invidious competition between students and to devalue learning. Ultimately, by the late nineteenth (...) century emulation as a specific pedagogical practice had disappeared in American educational culture. In this article, Mark Jonas and Drew Chambers ask whether the disappearance of emulation is something to be celebrated or lamented. To answer this question they examine the historical concept of educational emulation and analyze the bases on which proponents and opponents argued. Parties on both sides of the debate framed their arguments in close relation to the way emulation was being used at that time, which prioritized actual competitions and prizes. In that context, the opponents made a better case, which presumably contributed to emulation's disappearance in schools afterwards. However, as earlier proponents of emulation argued, emulation need not be restricted to competitions and prizes. Instead, these proponents offered a philosophically and psychologically rich defense of emulation, but these were not carried through to an appropriate degree. The authors conclude that, construed appropriately, emulation not only had tremendous educational potential then, but still does today. With intentional effort on the part of teachers, emulation can greatly enrich students' lives and act as a powerful learning motivator. (shrink)

Much contemporary first-order moral theory revolves around the debate between consequentialists and deontologists. Depressingly, this debate often seems to come down to irresolvable first-order intuition mongering about runaway trolleys, drowning children in shallow ponds, lying to murderers at doors, and the like. Prima facie, common sense morality contains both consequentialist and deontological elements, so it may be no surprise that direct appeal to first-order intuitions tend towards stalemate. One might infer from this that we should simply embrace some sort of (...) pluralism in the style of W.D. Ross, but there are problems with this approach too.I of course have in mind the sort of view defended by W.D. Ross. See W.D. Ross, The Right and the Good (Oxford: Oxford University Press, 1930). For one thing, pluralism provides precious little guidance in hard cases. It is commonly agreed that so-called echo chambers and epistemic bubbles, associated with social media, are detrimental to liberal democracies. Drawing on John Rawls’s political liberalism, we offer a novel explanation of why social media platforms amplifying echo chambers and epistemic bubbles are likely contributing to the violation of the democratic norms connected to the ideal of public reason. These norms are clarified with reference to the method of (full) reflective equilibrium, which we argue should be cultivated as (...) a civic virtue in the context of political justification. The paper demonstrates how epistemic bubbles and echo chambers are likely to be detrimental to the disposition to follow the method of reflective equilibrium in the political context. Based on this diagnosis the paper highlights the need for interventions that help cultivate reflective equilibrium as a civic virtue and the need for corresponding interdisciplinary research. Some writers even argued for a rather detailed correlation between awareness and physiological changes, suggesting that (a) the former could be adequately explained in terms of the latter or, in some few instances, (b) that the former are the latter. David Hartley may come to mind as fitting one or the other of (...) these alternatives, but Robert Hooke had earlier argued for ideas as brain impressions, as of course did Descartes in his early scientific treatises. There was also one medical doctor in the eighteenth century, Dr. Astruc, who seems (on the basis of what Chambers reports) to have attempted a very specific correlation between specific forms of awareness and specific states and changes in physiology. There were also writers in this century who warned against the dangers of using physical-object vocabulary when talking about the mind and acts of awareness. Berkeley is one such writer,- Thomas Reid at the end of the century traced, to the use of this vocabulary, what he took to be the indirect realism of the way of ideas. Hume is writing in both these traditions: the tradition of using physical language for characterizing mental operations and the tradition of physiological explanations and correlations. The phrase used by Alexander Pope and Hume, 'the anatomy of the mind', seems to be a mixed metaphor, but it is a phrase which I take as an indication that Hume is doing what we would call 'cognitive psychology'. Another phrase used by Hume (this time in the Enquiry), 'mental geography', may capture his enterprise better: 'geography' still sounds physical, but it is modified by 'mental'. Hume is engaged in mental mapping. I want to take a look at the use of the term 'idea' in Hume's writing (mainly in the Treatise) in order to see 2. whether Hume's text enables us to say anything about the nature of his ideas, to discover what role they play in his mental geography. As far as I can determine, there are three possible candidates for the nature of ideas in Hume: images, brain impressions, and cognitive contents. The first of these is, I think, the standard reading of Hume's ideas. Professor Anderson has presented strong argument and evidence to support the second. I will be suggesting that the third is the best candidate, given the full range of the text of the Treatise. Of course, the correct answer 4 may be all three of these. The Treatise opens by dividing all perceptions of the human mind into two kinds. Impressions and ideas differ in the degree of force and liveliness with which they strike upon the mind. Even though the language of 'force' and 'liveliness' may be borrowed from physical talk, it is the mind, not the brain, on which perceptions strike. The examples of impressions are sensations, passions, and emotions. Ideas are said to be the faint images of these impressions in thinking and reasoning. The term 'image' throughout the eighteenth century never receives any clear explication. Its inheritance from optical treatises always hangs about it. We should look to the examples cited by Hume, in order to see whether we can construct a meaning for that term when used in these psychological contexts. Let us look first at his very first example of 'ideas': all the perceptions excited by the present discourse. (Tl) He explicitly excludes from these perceptions those which arise from the sight and touch, as well as the immediate pleasure or uneasiness his discourse may excite in us. The perceptions which are thus excluded are sensations and emotions, the impressions he has just distinguished. The only candidate left for ideas would seem to be what this discourse says, our thoughts about it, my understanding of what it says. The distinction is not one Hume thinks is difficult to follow: Every one of himself will readily perceive the difference betwixt feeling and thinking. This narrative symposium examines the relationship of bioethics practice to personal experiences of illness. A call for stories was developed by Tod Chambers, the symposium editor, and editorial staff and was sent to several commonly used bioethics listservs and posted on the Narrative Inquiry in Bioethics website. The call asked authors to relate a personal story of being ill or caring for a person who is ill, and to describe how this affected how they think about bioethical questions and (...) the practice of medicine. Eighteen individuals were invited to submit full stories based on review of their proposals. Twelve stories are published in this symposium, and six supplemental stories are published online only through Project MUSE. Authors explore themes of vulnerability, suffering, communication, voluntariness, cultural barriers, and flaws in local healthcare systems through stories about their own illnesses or about caring for children, partners, parents and grandparents. Commentary articles by Arthur Frank, Bradley Lewis, and Carol Taylor follow the collection of personal narratives. (shrink)

The political system adopted by Restoration France seemed to call for opposition, and possibly even parties, on the model of Britain. The French, however, remained deeply divided by the Revolution, such that the civilities of parliamentary government developed only with difficulty. Reflecting the distrust inherited from the Revolution, deputies favoured a secret ballot for votes in the chambers and this alone made it easy to disguise political loyalties or to change them. Those who resisted the British model emphasized the (...) virtues of political choices that responded only to one's conscience and sense of honour. On that basis, party seemed inconsistent both with French individualism and with a sense of delicacy. Supporting the claims for indig- enous political mores were perceptions of British politics that exaggerated the discipline of their parties. Though party bonds in France remained very loose — and understanding of the logic of parliamentary government less than perfect — those now deemed the important political thinkers of the time were, in the main, admirers of the politics of party. Objective: To examine the current ethical review process of ethics committees in a non-pharmacological trial from the perspective of a clinical investigator.Design: Prospective collection of data at the Study Centre of the German Surgical Society on the duration, costs and administrative effort of the ERP of a randomised controlled multicentre surgical INSECT Trial between November 2003 and May 2005.Setting: Germany.Participants: 18 ethics committees, including the ethics committee handling the primary approval, responsible overall for 32 clinical sites throughout Germany. 8 ethics (...) committees were located at university medical schools and 10 at medical chambers. Duration was measured as days between submission and receipt of final approval, costs in euros and administrative effort by calculation of the product of the total number of different types of documents and the mean number of copies required .Results: The duration of the ERP ranged from 1 to 176 days. The median duration was 26 days at MSUs compared with 34 days at medical chambers. The total cost was €2947. 1 of 8 ethics committees at universities and 8 of 10 at medical chambers charged a median fee of €162 . The administrative effort for primary approval was 30. Four ethics committees required a higher administrative effort for secondary approval .Conclusion: The ERP for non-pharmacological multicentre trials in Germany needs improvement. The administrative process has to be standardised: the application forms and the number and content of the documents required should be identical or at least similar. The fees charged vary considerably and are obviously too high for committees located at medical chambers. However, the duration of the ERP was, with some exceptions, excellent. A centralised ethics committee in Germany for multicentre trials such as the INSECT Trial can simplify the ERP for clinical investigators in and outside the country. (shrink)

The article presents the emergence of the exhibition industry in Poland as an effect of a social and economic transformation, which took place in late 1980s and early 1990s. Several newly established enterprises started to learn the specificity of exhibition industry and to compete with the Poznań International Fair. Lack of professionalism, clear procedures and business reliability often led to misunderstandings and conflicts. Establishing Polish Trade Fair Corporation (PTFC) in 1993 had started the process of setting situation of the industry (...) in order but it did not solve some of the problems. The key problems still regard ethical issues. Although the ethical code of PTFC established rules of just competition, their efficiency depends mostly on their honest abiding. The article presents various examples of breaking the rules and major fields of conflict in the exhibition industry in Poland. In 2007 PTFC was replaced by newly established Polish Chamber of Exhibition Industry (PCEI). Its major challenges are verification of experience of almost twenty years of the exhibition industry in Poland and proposing new version of Ethical Code, so that the representatives of the industry respect it. The article provides an analysis of the European Court of Human Rights judgments in the case of Lautsi v. Italy (application no. 30814/06), also known as the Italian crucifix case. The applicant claimed that displaying crucifixes in the Italian State-school classrooms attended by her children was contrary to the principle of secularism, by which she wished to bring up her children, and therefore infringed her right to ensure their education and teaching in conformity with her religious and philosophical convictions, and (...) also breached her freedom of conviction and religion, as protected by Article 9 of the Convention. In its judgment of November 3, 2009, the seven-judge Chamber declared that there had been a violation of Article 2 (right to education) of Protocol No. 1 of the European Convention on Human Rights taken together with Article 9 (freedom of thought, conscience, and religion) of the Convention. The judgment was given unanimously and none of the judges appended a separate opinion. The Italian Government asked for the case to be referred to the Grand Chamber by virtue of Article 43 of the Convention. In the judgment of the Grand Chamber, delivered on March 18, 2011, the Court held, by fifteen votes to two (and with separate opinions of six judges), that there had been no violation of Protocol No. 1 and no violation of the Convention itself. The analysis in the article is focused on selected principal factors determining the Court's decision. It shows that the proposal for the Court to recognize secular convictions as those protected by Article 2 of Protocol No. 1 or Article 9 of the Convention has no sufficient basis in the Convention itself and in earlier Court's case-law and, even, may be considered as promotion of religious intolerance, threatening the freedom to publicly manifest a religion or belief, as guaranteed by Article 9 of the Convention. -/- Opracowanie zawiera analizę wyroków Europejskiego Trybunału, które zapadły w sprawie Soile Lautsi (app. 30814/06), zwaną „włoska sprawa krzyża” (Italian Crucifix Case). W sprawie tej skarżąca zarzucała, że okazywanie znaku krzyża w klasach włoskich szkół państwowych, do których uczęszczały jej dzieci, jest sprzeczne z zasadą sekularyzmu, zgodnie z którą chciała ona wychować swoje dzieci i dlatego stanowi naruszenie jej prawa do wychowania i nauczania zgodnego z jej religijnymi i filozoficznymi (moralnymi) przekonaniami, oraz stanowi naruszenie wolności religijnej, gwarantowanej art. 9 Konwencji. W wyroku siedmioosobowej izby ogłoszonym 3 listopada 2009 r. izba uznała naruszenie art. 2 (Prawo do nauki) Protokołu dodatkowego nr 1 do Konwencji o ochronie praw człowieka i podstawowych wolności w powiązaniu z art. 9 (Wolność myśli, sumienia i wyznania) Konwencji. Wyrok zapadł jednomyślnie i żaden z sędziów nie dołączył do wyroku swoich uwag. Rząd Włoch złożył wniosek w trybie przewidzianym art. 43 Konwencji o przekazanie sprawy do Wielkiej Izby. W wyroku Wielkiej Izby ogłoszonym 18 marca 2011 r. Trybunał uznał zdecydowaną większością głosów – 15 za wobec 2 przeciw (sześciu sędziów dołączyło swoje uwagi), że nie doszło do naruszenia ani Protokołu nr 1, ani samej Konwencji. Analizy koncentrują się na wybranych zagadnieniach, kluczowych dla argumentacji Trybunału. Analizy te pokazują, że postulowanie przez izbę uznania za prawo podmiotowe radykalnie pojętej negatywnej wolności religijnej, oraz postulowanie - tak przez izbę, jak i przez Wielką Izbę - ochrony przekonań sekularystycznych jako przekonań chronionych art. 2 Protokołu dodatkowego nr 1 lub art. 9 Konwencji, nie posiada należytego uzasadnienia ani w samej Konwencji, ani w dotychczasowym orzecznictwie Trybunału, a co więcej – może być uznane za propagowanie nietolerancji religijnej, godzącej przede wszystkim chronioną art. 9 Konwencji wolność publicznego uzewnętrzniania przekonań religijnych i filozoficznych. This chapter explores the arguments surrounding the use of human enhancement technologies in sport, arguing for a reconceptualization of the doping debate. First, it develops an overview and critique of the legislative structures on enhancement. Subsequently, a conceptual framework for understanding the role of technological effects in sport is advanced. Finally, two case studies (hypoxic chambers and gene transfer) receive specific attention, through which it is argued that human enhancement technologies can enrich the practice of elite sports rather than (...) diminish them. In conclusion, it is argued that elite sports are at a pivotal moment in their history as an increasing range of enhancements makes less relevant the protection of the natural human through anti-doping. Though scholarly consensus has long associated Beowulf with the Bear's Son folk tradition , many have felt that the Grendel episode comes closer to an Irish folktale called “the Hand and the Child.” Wilhelm Grimm first noticed the similarities between the episode and Irish narratives in which a hero defends a hall against a monstrous attacker, and variants of the folktale were adduced as analogues a century ago by Ludwig Laistner, Stopford Brooke, and Albert Stanborough Cook. In 1903 George Lyman (...) Kittredge collected variants, gave the story a name, and briefly discussed its structure and similarity to the poem. This study remains important for both sides in the subsequent debate because, while showing that the variants represented a widespread and consistent pattern, Kittredge expressed skepticism over its relationship to Beowulf. The war on terrorism, say America's leaders, is a war of Good versus Evil. But in the minds of the perpetrators, the September 11 attacks on New York and Washington were presumably justified as ethically good acts against American evil. Is such polarization leading to a violent "clash of civilizations" or can differences between ethical systems be reconciled through rational dialogue? This book provides an extraordinary resource for thinking clearly about the diverse ways in which humans see good and evil. (...) So it is perhaps not surprising to Wnd yEngland’s ygreat philosopher, Bertrand Russell, living in a little grey stone cottage on the side of a mountain and within sight of the sea. At a bend in a steep road, you suddenly come upon it: a typically Welsh looking place, for it is situated not far from the village of Llan Ffestiniogz—zin North Wales. It is small-scale country, this north-western corner of Merioneth: small steep hills; small glistening-green oak woods; small compact purple mountains (about 2,000 feet high). Ffestiniog village stands upon a ridge with a deep valley on either side; and a river, with white churning waterfalls, in each valley. From the grey stone terrace in front of Russell’s cottage, the whole Vale of Ffestiniog opens out to the shining estuary and the sea.2 The terrace has three tall, clipped, very prim looking bay trees; and all the cottage’s eight windows and two doors open out onto it; and Russell will tell you (with a lightly sardonic tone in his voice) that there were originally six trees, but that A.yS. Neill’s small scholars cut down three of them. (A.yS. Neill’s famous “experimental” school was evacuated here during the war.3 ) While Russell is himself an advocate of a very great deal of freedom in education, he thinks it is a pity if small children grow up without any knowledge whatever in their heads. The bare fact of talking with a ghost is bound to be curious and impressive—enough to make one start. But at the same time it’s not unusual to converse with ghosts, and this generalization can be taken beyond the sphere of literature, beyond the notion of writers struggling with the mighty dead for imaginative priority, as it is conceived in Harold Bloom’s readings of Browning, for instance. Derrida insists that relationship in general requires the spectral: “[w]hat happens between two, and between all the ‘two’s’ one likes, such as between life and death, can only maintain itself with some ghost, can only talk with or about some ghost [s’entretenir de quelque fantôme]” [Derrida, Specters of Marx xviii]. Perhaps, then, what happens in and between the two books reviewed here needs to be approached in terms of ghosts and the psychoanalysis of ghosts, so powerfully thematized by Nicholas Royle. [End Page 4] Both his After Derrida and Robert Smith’s Derrida and Autobiography seek to make contact with something in writing that gets things going and produces breaks, that displaces and startles. Although each volume could still be called a monograph on Derrida, it responds to something other than a corpus.The sense of shock, wonder, and discontinuity that makes the imagined interlocutor in “Memorabilia” laugh illuminates also something playing itself out across the reception of Derrida’s work. Part of that reception could be conceived in familiar terms—the development of a canon of what could be called Derrida commentaries, the establishment of a set of themes readily associated with Derrida studies (charlatanism, the deconstruction of a metaphysics of presence, and so on). Yet to speak with or about ghosts entails having to start reading, listening, and thinking again, in order to broach familiarity anew without innocent recourse to sheer intuition. These books also, despite their scholarly knowledge of the field, share a sense of responsibility to discuss an aspect of writing—hard to ignore in Derrida—that has begun without commentary, that gets commentary started and that subjects the movement of thought to something like fits. Whether these fits are of phobia, laughter, melancholy, delirium, or anger, their irruption marks interesting gaps in thought’s continuity. More than moods, these strange outbursts might be understood better in terms of the theory of metapsychological “phantoms.” The phantom, according to Nicolas Abraham, is “sustained by secreted words, invisible gnomes whose aim is to wreak havoc, from within the unconscious, in the coherence of logical progression” [“Notes on the Phantom” 175]. This article analyses the book on Beethoven, which Adorno worked on for more than 30 years without having time to complete it. The long-awaited French translation now makes it possible to fully appreciate the importance of this volume, which is, at the same time, a workshop and an echo chamber for Adorno’s entire work. The main thrust of the book is the connection between Beethoven and Hegel, which raises the issue of a relationship between identity and difference that ensures that (...) otherness is not absorbed into the economy of speculative thought. In this respect, we should first bear in mind that, for Adorno, it is to the very extent that Beethovenian form aims at the constitution of an “intensive totality” that it leads to the exposure, within and through aesthetic appearance, of the arbitrary character of such primacy granted to the whole. If this is the “truth content” of this music, then we might consider that Beethoven’s “late style” (a reasoning present from the first to the last of Adorno’s texts on the composer) constitutes its full unfolding, as a critique, immanent in the musical material, of the illusion of the reconciled. While it is well known that the last quartets or sonatas are exemplary of such a gesture, we wished to show that it was both duplicated and altered in the composition of the Missa solemnis, which Adorno said he could not understand. We, therefore, put forward the following assumption: this tension between two forms of distancing, or “estrangement” (Verfremdung), expresses in an eminent way untimeliness that runs through the whole of Beethoven’s work, and at the same time crystallises the fundamental theoretical requirements of this reform of dialectics that Adorno calls negative dialectics, and, inseparably, of the concept of a non-linear, non-teleological historical temporality.
